KONDAA – TERMS & CONDITIONS

Welcome to KONDAA. KONDAA is a technology platform that enables customers to discover local businesses, access individual vendor websites, place online orders, and communicate with participating vendors.

By accessing or using KONDAA websites, web applications, mobile applications, or vendor websites powered by KONDAA, you agree to these Terms & Conditions.

1. About KONDAA

KONDAA provides technology and online ordering services for participating local businesses such as restaurants, hotels, grocery stores, fish and meat shops, fruit and vegetable stores, bakeries, and other eligible businesses.

KONDAA may provide each participating vendor with an individual online website or digital storefront.

KONDAA is primarily a technology and platform service provider. Unless specifically stated otherwise, the products and services displayed on a vendor's website are supplied by the respective vendor.

2. Vendor Responsibility

Each vendor is responsible for:

The accuracy of product/menu information.
Product quality and availability.
Prices, taxes and applicable charges.
Accepting or rejecting orders.
Preparing and packing orders.
Customer service relating to the vendor's products.
Compliance with applicable laws and licences.
Delivery when the vendor chooses Self Delivery.

KONDAA does not manufacture or directly supply products listed by independent vendors unless specifically stated.

3. Individual Vendor Websites

KONDAA may provide participating vendors with an individual website or online storefront.

The individual vendor website may display:

Vendor name and logo
Products or menu
Prices
Offers
Business information
Online ordering facilities
Contact information
Delivery information

The vendor is responsible for maintaining accurate business and product information.

4. Customer Orders

When a customer places an order through KONDAA or an individual vendor website:

The order is submitted to the respective vendor.
The vendor may accept or reject the order based on availability, operating hours, location, or other reasonable circumstances.
Once accepted, the vendor prepares the order.
Delivery is handled according to the delivery option selected or provided by the vendor.

An order is considered confirmed only after the vendor accepts or confirms it.

5. Self Delivery

Participating vendors may provide their own delivery service.

Under Self Delivery:

The vendor is responsible for delivery.
The vendor may determine its delivery area and applicable delivery charges.
Delivery time may vary depending on distance, traffic, weather, order volume and other circumstances.
KONDAA is not responsible for delays caused by the vendor's delivery operation.

6. KONDAA Delivery Support

KONDAA may introduce its own delivery service in selected locations in the future.

Where available, delivery may be provided either by KONDAA or by authorised delivery partners.

Applicable delivery charges and delivery terms will be displayed to customers before order confirmation.

7. Prices and Charges

Product prices are determined by individual vendors.

KONDAA may charge vendors a subscription or other applicable platform/service fees according to the vendor's selected plan.

Customers may be required to pay:

Product/menu price
Applicable taxes
Delivery charges, where applicable
Other clearly disclosed charges

All applicable charges should be displayed before order confirmation.

8. Payments

KONDAA may support different payment methods including online payment and Cash on Delivery, depending on the vendor, location and available payment services.

Where online payments are processed through a third-party payment provider, the payment provider's terms may also apply.

KONDAA does not store complete card, UPI or banking credentials unless expressly stated and permitted by applicable law.

9. Cancellation and Refunds

Cancellation and refund eligibility may depend on:

Vendor cancellation policy
Order preparation status
Payment method
Product type
Applicable law

Perishable products such as food, meat, fish, fruits and vegetables may have specific cancellation and refund conditions.

Customers should contact the vendor or KONDAA support as soon as possible regarding an order issue.

10. Product Quality and Food Safety

For food and other consumable products, the respective vendor is responsible for:

Product quality
Hygiene
Food safety
Packaging
Ingredients and allergen information where applicable
Required licences and regulatory compliance

Customers should review the information provided by the vendor before placing an order.

11. Pharmacy / Medicine Products

If medicine or pharmacy delivery is introduced on KONDAA, such services will be provided only through eligible and appropriately licensed businesses and subject to applicable laws, prescription requirements and regulatory restrictions.

KONDAA may restrict or remove products that cannot legally be offered through the platform.

12. Customer Accounts

Customers may be required to provide accurate information such as:

Name
Mobile number
Delivery address
Payment information where required

Customers are responsible for keeping their account information accurate and for maintaining the security of their login credentials.

13. Prohibited Use

Users must not:

Provide false information.
Create fraudulent orders.
Misuse offers or promotional codes.
Attempt unauthorised access to the platform.
Interfere with the operation of KONDAA.
Upload unlawful, abusive or misleading content.
Use the platform for fraudulent or illegal activities.

KONDAA may suspend or terminate accounts involved in abuse, fraud or violation of these Terms.

14. Vendor Subscription

Vendors may subscribe to KONDAA plans based on the applicable product/menu limits, order limits and features.

The subscription fee, included limits and additional charges will be communicated to the vendor before subscription or renewal.

KONDAA may modify its plans and pricing by providing reasonable notice.

15. Intellectual Property

The KONDAA name, logo, software, website design, application, graphics, text and platform technology are owned by or licensed to KONDAA and may not be copied, reproduced or commercially used without permission.

Vendors retain ownership of their own trademarks, logos, photographs and business content, subject to the licence necessary for KONDAA to operate and promote their online storefront.

16. Third-Party Services

KONDAA may integrate third-party services such as:

Payment providers
Maps and location services
SMS/OTP services
Hosting and cloud services
Analytics services
Other technology providers

Third-party services may have their own terms and privacy policies.

17. Availability

KONDAA aims to maintain reliable services but does not guarantee that the platform will always be uninterrupted or error-free.

Services may occasionally be unavailable because of maintenance, technical problems, internet issues, third-party services, force majeure events or other circumstances beyond reasonable control.

18. Limitation of Liability

KONDAA is a technology platform and is not responsible for the quality, safety, preparation, packaging or legality of products supplied by independent vendors, except to the extent required by applicable law.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited.

19. Changes to These Terms

KONDAA may update these Terms & Conditions from time to time.

Updated terms will be published on the KONDAA website with the revised date.

Continued use of the platform after an update constitutes acceptance of the revised Terms, subject to applicable law.
